Lost luggage, more than one carrier involved. Who's responsible for compensation?

On my return home from vacation a had an itinerary in which the carrier that I booked through, China Southern, covered the first two legs of an international flight (two flights with one layover in between). The last leg of the trip was a domestic flight covered by Virgin America. The first China Southern flight was delayed and the connection for the second flight was almost missed. When I arrived back in the US to process customs and make the last connection, my bags hadn't made it. I was told I would have to wait until I got to my final destination to file a claim.

So at my final destination I go to Virgin's office to file a claim because there are no reps of offices for China Southern. I submit my claim to Virgin and they said that they will handle it. I also emailed China Southern their response was to have Virgin handle it. Sounds good but the thing is I know that Virgin never received the bags from China Southern because the bags never arrived. The bags were never processed through customs, and I did not check them in with Virgin (the last layover was overnight so I checked into Virgin at their counter the next morning).

In all likelihood the bags are sitting around in China where my first connection was. I'm worried that Virgin America will trace the bags back and realize that they never received them and be absolved of responsibility. Why would they cover bags that they never received for a passenger that did not book through them? This happened yesterday and my other worry is that by the time I hear back from Virgin it will be outside of the seven day window I have to file with China Southern. I would file with them if I could but they keep placing the responsibility on Virgin and they have no local office to talk to anyone in person.

There is stuff in my checked bags that I would just prefer to get back, but I may have to deal with being compensated. I'm at home now so I have what I need to get by without the bags. Additionally, I bought the tickets with AMEX and they have limited baggage insurance. Does anyone have any insight on this and/or any tips?
